Terms of Use and Sale (CGU/CGV)

1. Legal information and scope
These Terms of Use and Sale govern access to and use of the services provided by the operator (the 'Publisher') through the Flitt website and platform.
They apply to any user and, where applicable, to any purchase of subscriptions or services.
2. Definitions
Account: a personal access allowing use of the Services.
Content: data, files, messages, configurations and metrics submitted by the User.
Services: features provided through the Platform (dashboard, analytics, integrations, support, etc.).
3. Description of Services
Flitt provides server management tools, analytics, integrations and customer support, including real-time and historical features. Services may rely on addons/plugins (FiveM, Garry’s Mod, Minecraft), webhooks, APIs, and the optional Edge SDK for local storage and routing.
Services may evolve and be subject to technical, regional, quota or plan limitations.
4. Account, access and security
You must have an account and valid credentials to access the Services.
You are responsible for keeping your credentials confidential and for all activity under your account.
You agree to provide accurate and up-to-date information.
You must meet the applicable minimum legal age or have parental authorization where required.
5. Acceptable use
Do not use the Services for illegal, fraudulent or abusive purposes.
Do not bypass security measures or attempt unauthorized access.
Do not disrupt the Platform (DDoS, excessive scraping, reverse engineering, etc.).
Comply with applicable local laws including export controls and data protection.
Reviews must be honest, relevant and constructive. Negative reviews are allowed when they are factual and reasoned; insulting, trolling or defamatory content is prohibited.
6. User content and data
You remain owner of your Content. You grant the Publisher a worldwide, non-exclusive license limited to performing the Services to host, process and display your Content.
You warrant you have the rights to submit such Content and, when you collect player data or logs, that you have informed end users and obtained any required permissions under applicable laws.
7. Intellectual property
The Platform, its brands, content and software remain the exclusive property of the Publisher or its licensors. You are granted a limited, non-exclusive, revocable license to use the Services under these Terms.
8. Third-party services and integrations
Some features rely on third-party services (e.g., Discord for OAuth, hosting providers, payment processors such as Stripe). Use of those services is subject to their own terms; the Publisher is not responsible for their unavailability or changes.
9. Subscriptions, trials and billing
Paid Services are described on the Platform. Unless stated otherwise, subscriptions renew automatically on a monthly or yearly cycle.
You may cancel at any time; access remains until the end of the paid period. Free trials are time-limited, available once per account, and currently last 7 days for eligible plans (Premium/Pro Edge).
If a trial ends without an active subscription, the account is downgraded to Freemium.
10. Pricing, taxes and payments
Prices are displayed on the pricing page in the indicated currency (currently EUR) and may change with notice.
Payments are processed by third-party providers (Stripe). Local taxes/VAT may apply depending on your location.
Invoices and billing history are available in your account where supported.
11. Withdrawal and refunds
For consumers in certain jurisdictions a right of withdrawal may apply (e.g., 14 days in the EU), except for digital content or services delivered with the user's prior consent to immediate performance and acknowledgment of loss of withdrawal right.
Refund conditions are described at purchase and in your billing portal.
12. Suspension, termination and deletion
We may suspend access in case of breach of these Terms, risky activity or non-payment. We may also apply targeted restrictions (e.g., disabling reviews, server creation, the Public API, or support) in case of abuse. These restrictions may remain in effect even after account deletion and apply to any new account linked to the same Discord identifier. You may terminate at any time as described. Certain obligations (payments due, IP, liability limits) survive termination.
13. Support, maintenance and availability
Support and maintenance are provided via the channels indicated on the Platform. Scheduled or emergency maintenance may occur. Unless otherwise agreed, no SLA is guaranteed.
14. Warranties and exclusions
Services are provided 'as is'. To the extent permitted by law, implied warranties of merchantability, fitness for a particular purpose and non-infringement are disclaimed. Some jurisdictions do not allow such exclusions.
15. Limitation of liability
To the fullest extent permitted by law, the Publisher is not liable for indirect damages or data loss. Total liability is limited to the amount paid for Services in the prior 12 months.
16. Indemnification
You agree to indemnify the Publisher against third-party claims arising from your use of the Services, your Content, or breach of these Terms.
17. Data protection
Personal data processing is described in the Privacy Policy. EU users have rights under the GDPR; US users have rights under applicable state laws (e.g., CCPA/CPRA in California).
If you use addons/plugins or the Edge SDK to collect player data, you are responsible for lawful collection, notices, and required consents toward your end users.
18. Changes
We may modify these Terms. For material changes you will be notified via the Platform. Continued use constitutes acceptance.
19. Governing law and disputes
These Terms are governed by the laws of France, subject to mandatory local consumer protections. Disputes should first seek amicable resolution; mediation may be offered for EU consumers.
